Marital Torts
Marital or inter-spousal
torts are a growing trend within Family Law practice. Broadly defined, they
include instances of abuse, infliction of a sexually transmitted disease or
other wrongful acts between couples.
While marital torts
do address important issues, many attorneys are creatively using them to
circumvent California's
"no-fault divorce act" in order to take a greater portion of
community property in dissolution proceedings.
The proliferation
of marital torts and their impact on California's
